SavionTech Terms of Service

1. Acceptance of Terms & Eligibility

By submitting your information through any SavionTech advertisement, landing page, or opt-in form — or by using any SavionTech service as a mortgage broker, licensee, or platform user — you agree to be bound by these Terms of Service. If you do not agree, do not submit your information or use our services.

You must be at least 18 years of age to use our services. By opting in or otherwise engaging with SavionTech, you represent and warrant that you are at least 18 years old and legally capable of entering into a binding agreement. Our services are intended for adult homeowners and licensed mortgage professionals only.

2. Description of Services

SavionTech operates a lead generation and voicemail automation platform that connects homeowners interested in mortgage rate information with licensed mortgage brokers. Our services include:

Cold Lead Generation

We run targeted social media advertisements on platforms including Facebook and Instagram to identify homeowners who express interest in mortgage rate alerts. Consumers who opt in are contacted through an automated voicemail and SMS sequence. Those who confirm their interest by calling back are classified as verified leads and delivered exclusively to a single licensed mortgage broker.

Database Reactivation

Mortgage brokers may provide us with a list of their existing clients or referrals. We use that list to build a Facebook Custom Audience and run targeted advertisements specifically to those individuals. Verified opt-ins from that audience are returned exclusively to the broker who provided the list and are not shared with any other party.

Voicemail System Licensing

We license access to our GoHighLevel-powered voicemail automation system to mortgage brokers on a monthly subscription basis. Licensees use the system on their own client databases under their own compliance obligations. SavionTech is not responsible for how licensees deploy the technology on contacts outside of our managed campaigns.

Platform Operations

All lead capture, automation, voicemail delivery, SMS messaging, pipeline tracking, and lead delivery are managed through GoHighLevel. Use of our platform is subject to GoHighLevel's own terms of service in addition to these terms.

3. SMS and Voicemail Communications

By submitting your phone number through a SavionTech opt-in form or advertisement, you expressly consent to receive automated communications including:

  • Ringless voicemail messages delivered directly to your voicemail inbox. Your phone may ring briefly — typically for a fraction of a second up to a few seconds — before the message is deposited.
  • SMS text messages referencing the voicemail and inviting you to respond.
  • Follow-up voicemail and SMS messages if you do not respond within 24 hours.
  • Additional automated outreach as part of a 7-day follow-up sequence.
Opt-Out

You may opt out of all SMS communications at any time by replying STOP to any text message you receive from us. After opting out, you will receive one confirmation message and no further contact. To opt out of voicemail communications, contact us directly at the address below.

Message and Data Rates

Message and data rates may apply for messages sent to you from us and from you to us. Message frequency varies based on your interaction with our system.

Carrier Disclaimer

T-Mobile, AT&T, Verizon, and other mobile carriers are not liable for delayed or undelivered messages. SavionTech is not responsible for delivery failures caused by carrier routing, number blocking, or device settings.

4. TCPA Compliance

All consumer contacts initiated through SavionTech's platform are based on documented prior express written consent that meets the requirements of the Telephone Consumer Protection Act (TCPA). We maintain a timestamped consent record for every opt-in, including the exact disclosure language presented at the time of opt-in, the date and time of consent, and the IP address from which consent was submitted.

If you believe you have received a communication from us in error — including if you did not submit your information through one of our forms — please contact us immediately at the address below. We will investigate and remove you from all contact lists promptly.

Mortgage brokers and licensees who use our voicemail system on their own databases are solely responsible for maintaining their own TCPA compliance, including documenting consent for every contact they add to an automated sequence. SavionTech assumes no liability for TCPA violations arising from a broker's independent use of the licensed system.

5. Lead Delivery Terms (Broker Clients)

The following terms apply to licensed mortgage brokers and lending professionals who purchase leads or otherwise receive verified contacts from SavionTech.

Exclusivity

Each verified lead is sold to one broker only. Once a lead has been delivered, it will not be re-sold or re-delivered to any other party. SavionTech does not operate a multi-buyer or shared-lead model.

Lead Quality and Verification

A lead is classified as verified when the consumer has (a) submitted their information through an opt-in form and (b) called back in response to our automated voicemail outreach, confirming active interest. SavionTech does not guarantee that any lead will result in a closed loan or that contact information will remain accurate after delivery.

No Resale

Broker clients may not resell, redistribute, or share verified leads received from SavionTech with any third party. Leads are licensed for use by the purchasing broker only.

Database Reactivation Lists

When a broker provides a contact list for database reactivation, the broker represents and warrants that they have a lawful basis to share those contacts with SavionTech and that those contacts have not opted out of communications from that broker. SavionTech will use the list solely to build a Custom Audience for the broker's campaign and will not market to those contacts on behalf of any other broker or party.

Speed of Contact

Verified leads are delivered to the broker within minutes of callback confirmation. Brokers are strongly advised to contact leads as quickly as possible. SavionTech is not responsible for conversion outcomes affected by delays in broker follow-up.

6. User Responsibilities

All users of SavionTech services — including consumers who opt in through our advertisements and brokers who purchase leads or license our platform — agree to the following:

  • You will provide accurate, complete, and current information when submitting any form or entering into any agreement with SavionTech.
  • You will use our services only for lawful purposes and in compliance with all applicable federal, state, and local laws and regulations.
  • You will not attempt to reverse-engineer, copy, replicate, or redistribute the SavionTech platform, automation workflows, or lead generation methodology.
  • You will not use our platform to contact individuals who have opted out or requested to be placed on a Do Not Call list.
  • You will not misrepresent your identity, credentials, or licensing status when interacting with leads delivered through our platform.
7. Payments, Refunds & Cancellations
Payment

SavionTech accepts credit card payments for lead purchases, database reactivation campaigns, and voicemail system licensing. All fees are due at the time of purchase or in accordance with the billing schedule established in your service agreement.

Lead Refunds

Because leads represent a verified consumer interaction that has already occurred, all lead sales are final. SavionTech does not offer refunds on delivered leads. If you believe a lead was delivered in error, does not meet the verified standard described in Section 5, or contains materially inaccurate contact information, please contact us within 48 hours of delivery and we will review the record.

Subscription Cancellations

Monthly voicemail licensing subscriptions may be cancelled at any time. Cancellations take effect at the end of the current billing period. No partial-month refunds are issued. To cancel, contact us at the address below.

Ad Campaign Fees

Database reactivation campaigns require an upfront setup fee and advertising budget commitment. Once a campaign has launched and ad spend has been committed to Meta, those costs are non-refundable.

8. Intellectual Property

All content, workflows, automation sequences, ad creatives, landing page designs, and platform configurations developed by SavionTech are the intellectual property of SavionTech. Nothing in these terms grants you a license to reproduce, distribute, or create derivative works from any SavionTech proprietary materials.

Voicemail system licensees receive a limited, non-exclusive, non-transferable license to use the GoHighLevel-based automation infrastructure during their active subscription period only. This license does not include the right to copy, modify, sublicense, or resell the system or any component of it.

9. Limitation of Liability

To the fullest extent permitted by applicable law, SavionTech shall not be liable for:

  • Indirect, incidental, consequential, punitive, or special damages of any kind
  • Lost revenue, lost profits, or loss of business opportunity arising from the use or inability to use our services
  • Service interruptions, platform downtime, or delivery delays beyond our reasonable control
  • Losses resulting from inaccurate information provided by users, consumers, or broker clients
  • TCPA violations or regulatory actions arising from a broker's independent use of the licensed voicemail system
  • Actions taken or not taken by mortgage brokers after receiving a delivered lead
  • Ad account suspensions, platform policy changes, or algorithm updates by Meta or any other third-party advertising platform

SavionTech's total liability to any party for any claim arising under these terms shall not exceed the total fees paid by that party to SavionTech in the 30 days preceding the claim.

10. Disclaimers

SavionTech provides lead generation and communication automation services only. We are not a mortgage lender, mortgage broker, or financial advisor. Nothing on our platform, in our advertisements, or in any communication from us constitutes financial, legal, or investment advice.

We do not guarantee any specific lead volume, cost per lead, callback rate, or conversion outcome. Campaign performance depends on market conditions, rate environments, ad platform algorithms, and factors outside our control. Past performance of any campaign or metric described in our materials does not guarantee future results.

11. Dispute Resolution

These Terms of Service are governed by the laws of the United States and the state in which SavionTech is registered, without regard to conflict of law principles.

In the event of a dispute arising from or related to these terms or our services, you and SavionTech agree to first attempt to resolve the matter informally by contacting us in writing at the address below. If the dispute is not resolved within 30 days of written notice, either party may pursue resolution through binding arbitration or the appropriate court of competent jurisdiction.

You agree to bring any claim on an individual basis only. Class action lawsuits and class-wide arbitration are expressly waived to the extent permitted by applicable law.

12. Privacy

Your use of SavionTech services is subject to our Privacy Policy, which explains how we collect, use, retain, and protect your personal information, including how we handle opt-in consent records, lead data, and SMS communications. 13. Changes to Terms or Services

SavionTech may update these Terms of Service at any time to reflect changes in our business practices, services, or legal requirements. When we make material changes, we will update the Effective Date at the top of this document. Your continued use of our services after any update constitutes your acceptance of the revised terms.

We reserve the right to modify, suspend, or discontinue any service or feature at any time without prior notice. SavionTech shall not be liable to you or any third party for any modification, suspension, or discontinuation of services.
